Terms of Use

1. The agreement
These Terms of Use are an agreement between you and Mixtape Cat ("we," "us") covering the Mixtape Cat app and mixtapecat.com (together, the "Service"). By using the Service you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. What Mixtape Cat is
Mixtape Cat lets Apple Music subscribers make, decorate, share, and catch mixtapes. Playing music requires your own active Apple Music subscription, which is a separate agreement between you and Apple and is billed separately by Apple. Mixtape Cat is an independent app: it is not affiliated with, endorsed by, or sponsored by Apple Inc.
3. Your content
The tapes you make are yours. When you share a cassette or publish a profile, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the Service — in the public feed, on share pages, and in previews of them — for as long as it remains shared. Unsharing or deleting content ends that license, apart from short-lived backups. You're responsible for what you publish and must have the rights to anything you upload (like avatar images and sticker artwork).
4. The music itself
Songs, artwork, and metadata are provided through Apple Music and belong to their rights holders. Your use of that content is governed by Apple's Media Services terms. Mixtape Cat gives you no rights to the underlying recordings.
5. House rules
- Don't publish content that's illegal, infringing, hateful, pornographic, harassing, or that targets private individuals.
- Don't impersonate other people or squat usernames.
- Don't attempt to defeat feature gating, purchases, moderation, or other users' privacy, and don't probe, scrape, or disrupt the Service.
- Keep it worthy of the mixtape: this is a place for sharing music you love, not for spam or promotion schemes.
We may remove content, restrict accounts, or terminate access for conduct that breaks these rules, with or without notice. If you see something that shouldn't be here, report it via Contact.
6. Mixtape Cat Neon — subscriptions
Mixtape Cat Neon is an optional auto-renewing subscription (monthly or annual) that unlocks premium features such as unlimited mixtapes. The price is shown in the app before you buy.
- Payment is charged to your Apple Account at confirmation of purchase. We never receive your payment details.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel anytime in your device's App Store subscription settings. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under Apple's refund policies; we can't issue them directly.
- If a subscription lapses, is refunded, or is revoked, premium features return to the free tier — your existing tapes are never deleted, though you can't create new ones beyond the free limit.
- We occasionally grant Neon free of charge (for testers, for example); such grants are courtesy access and may be withdrawn at any time.
- The exact set of Neon features may evolve over time.
7. The free tier
Making, decorating, sharing, and catching mixtapes (up to the free limit) is free. We may change what the Service offers, or discontinue it, though we'll aim to give reasonable notice of anything significant.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that shared content will be preserved forever — keep your own copies of anything you care about.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost data or profits, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim arose.
10. Termination
You can stop using the Service at any time and reset your account from the app's settings. We may suspend or terminate access for violations of these terms. Sections 3 (as to past sharing), 8, 9, and 11 survive termination.
11. Governing law
These terms are governed by the laws of the United States and the state of our principal place of business, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remains in effect.
12. Changes to these terms
We may update these terms as the Service evolves; the date above reflects the latest revision. Material changes will be flagged in the app or on this site. Using the Service after a change means the updated terms apply.
